These Terms and Conditions of Sale govern all purchases made through Ambientech.es. By placing an order, the customer confirms acceptance of these Terms. The contractual relationship between the customer and Ambientech.es is governed by Spanish law, including the Código Civil, Real Decreto Legislativo 1/2007 (Ley General para la Defensa de los Consumidores y Usuarios), and Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE).
EU consumer protection and ecommerce legislation also applies, including Directive 2011/83/EU on Consumer Rights, Directive 2000/31/EC on Electronic Commerce, Directive 93/13/EEC on Unfair Terms in Consumer Contracts, and Directive 2019/771/EU on the sale of goods.
1. Business Identity and Scope
Ambientech.es is operated by Grupo Cato 2009 SL and acts as a seller and distributor of environmentally improved technical products, including but not limited to marine coatings such as Coppercoat, fuel additives, fuel system cleaning solutions, and related products.
Products are currently intended primarily for marine applications but may also be suitable for other transport sectors. Ambientech.es operates in both B2C and B2B markets. These Terms apply to all sales made within Spain and the European Union in accordance with applicable EU distance selling and consumer protection legislation.
2. Product Information
All products are described with reasonable accuracy, including images, specifications, and technical descriptions. Minor variations that do not affect the essential characteristics of the product may occur and are permitted under Directive 2019/771/EU.
Ambientech.es reserves the right to correct typographical errors, pricing errors, or inaccuracies, and to update product information at any time.
In the event of a clear and obvious pricing or technical error, Ambientech.es may cancel the order and issue a full refund in accordance with the Código Civil provisions on contractual error affecting consent.
3. Prices and Taxes
All prices displayed on Ambientech.es include Spanish VAT unless otherwise stated, in accordance with Spanish tax law. Any additional taxes, duties, or charges applicable to specific destinations are clearly disclosed during checkout.
Prices are binding only at the time the order is confirmed, in line with LSSI-CE and Directive 2011/83/EU transparency requirements.
4. Payment Methods and Contract Formation
Payments may be made via Stripe (credit and debit cards), PayPal, bank transfer, or WooPayments. Guest checkout is permitted.
The sales contract is considered concluded when the customer receives the order confirmation email, in compliance with LSSI-CE and Directive 2000/31/EC. Customers are responsible for safeguarding any account credentials used on the website.
5. Order Availability and Cancellation
Orders are processed in the order they are received. If a product becomes unavailable after an order has been placed due to stock or supply issues, Ambientech.es will inform the customer and issue a full refund, in compliance with Real Decreto Legislativo 1/2007.
Customers may cancel an order prior to preparation for shipment. Once an order has been prepared or dispatched, cancellation is no longer possible.
6. Shipping and Delivery
Orders are shipped using NACEX or equivalent carriers. Estimated delivery times are:
- Spain Peninsula: 24 to 72 hours
- Balearic Islands: 3 to 5 business days
Delivery times are estimates only. Ambientech.es is not liable for delays caused by carriers, weather conditions, customs processes, or other circumstances beyond its reasonable control, in accordance with Directive 2011/83/EU and Regulation (EU) 2018/644 on parcel delivery services.
7. Right of Withdrawal and Returns
Consumers have the right to withdraw from their purchase within 14 calendar days from the date of delivery, in accordance with Directive 2011/83/EU and Real Decreto Legislativo 1/2007.
Return shipping costs are borne by the customer.
Return conditions:
- Products must be unused and returned in original packaging
- All accessories and documentation must be included
- The customer must provide photographs for return approval
Excluded products:
- Coppercoat and other chemical or coating products requiring special handling or that may deteriorate once opened
These exclusions are permitted under Directive 2011/83/EU for goods that deteriorate quickly or are sensitive in nature.
Refunds are issued using the original payment method once the return has been approved and received.
8. Warranty
All products are covered by the three-year legal guarantee established under Real Decreto Legislativo 1/2007 and Directive 2019/771/EU.
The warranty covers manufacturing defects only. It does not cover damage resulting from improper installation, incorrect surface preparation, failure to follow instructions, lack of maintenance, misuse, or exposure to conditions outside the intended technical or environmental use.
9. Customer Responsibility for Technical and Environmental Products
For specialized products such as Coppercoat, fuel additives, and cleaning solutions, the customer is solely responsible for ensuring correct preparation, mixing, application, usage, and compliance with environmental and safety conditions.
Failure to follow technical instructions or product guidelines voids any warranty and excludes liability, as permitted under applicable consumer and contract law.
10. Limitation of Liability
To the maximum extent permitted by Spanish and EU law, Ambientech.es excludes liability for:
- Indirect or consequential damages
- Loss of profits, business interruption, or loss of opportunity
- Delays caused by carriers, force majeure, or external circumstances
- Improper installation, professional handling errors, or misuse
- Environmental damage or corrosion resulting from incorrect application
Total liability is limited to the purchase price of the affected product. Mandatory consumer rights under Real Decreto Legislativo 1/2007 remain unaffected.
11. Digital Invoices
Invoices are issued exclusively in electronic format and sent by email, in compliance with LSSI-CE and applicable tax and data protection regulations. Printed invoices are not provided.
12. Data Protection
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Customers may exercise their rights of access, rectification, erasure, restriction, objection, and data portability as described in the Ambientech.es Privacy Policy.
13. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any dispute shall be submitted to the courts of Alicante, Spain, unless mandatory consumer protection rules grant the customer the right to bring proceedings in their place of residence.
14. Language
If these Terms are translated into another language, the English version shall prevail in the event of any discrepancy, in accordance with Directive 2011/83/EU.
